Legal to Buy and Use: Yes, at 21 and Over

Federal law sets 21 as the minimum age for the sale of tobacco products, and the FDA's Tobacco 21 page lists e-cigarettes among the products covered. The FDA regulates vaping devices and their components as tobacco products, and the age rule attaches to the device category rather than to the nicotine content of a particular liquid. In practice every US retailer, ours included, applies the 21+ rule to zero-nicotine devices, and age verification happens at checkout and again at delivery.

So the direct answer to "can you buy nicotine free vapes under 21" is no, not from any compliant seller. A shop that will sell a 0mg disposable to someone under 21 is a shop that is not following the rules on its nicotine products either, which is a reason to buy elsewhere regardless of your age.

Using a nicotine free vape is not itself restricted by federal law for adults, but where you can use it is governed by the same indoor-air and property rules as any vape. Workplaces, schools, airlines, and most public buildings prohibit vaping without distinguishing nicotine strength, and a 0mg device produces the same visible aerosol as a nicotine one. Why a 0mg Vape Needs an Adult Signature on Delivery

Can You Take a Nicotine Free Vape on a Plane?

Yes, in your carry-on bag or on your person, and never in checked luggage. The TSA's rule for electronic cigarettes and vaping devices prohibits them in checked bags because of the lithium battery, and the FAA's PackSafe guidance adds that the device must be protected from accidental activation, which means switching off any device with a power button and keeping disposables in a case where the mouthpiece cannot be pressed.

None of these rules mention nicotine. A 0mg disposable is treated identically to a nicotine one at the checkpoint, so do not expect the zero label to change anything: it goes in the carry-on, it stays off during the flight, and using it on board is prohibited on every US airline. Will a Nicotine Free Vape Show Up on a Drug Test?

A genuine 0mg vape contains no nicotine, so there is nothing in it to produce cotinine, the nicotine metabolite that nicotine screening tests look for. Standard drug panels for illegal substances do not test for propylene glycol, vegetable glycerin, or food flavorings, and a zero-nicotine disposable from a mainstream brand contains no THC or other controlled substance. On a correctly labeled product, the answer is no.

The caveat is the label. A device sold as nicotine free that actually contains nicotine will produce cotinine like any other nicotine product, and mislabeled stock is the main risk in this category. State and Local Rules: What Changes and What Does Not

Federal rules set the floor; states and cities build on it. The additions that most often touch a zero-nicotine buyer fall into three groups.

• Flavor restrictions. Several states and cities restrict the sale of flavored vaping products. Some of those laws are written around nicotine products and leave 0mg alone; others are written around the device or the flavored liquid and capture 0mg as well.
